What are cookies?
Cookies are small files that are stored on your computer when you visit a website. They collect information about your preferences and make it easier for you to visit them again in the future.
On June 4, 2014, the Italian Data Protection Authority, with a provision published in the Official Journal, identified simplified procedures for informing users about the use of cookies on websites and obtaining consent when profiling cookies are used.
All companies with a website are required to comply with current legislation by May 2015, ensuring correct user information and obtaining prior authorization to use cookies.
Sanctions
Il Garante della Privacy "tenuto conto dell'impatto anche economico della norma" prevede "un tempo di adeguamento di un anno a decorrere dalla pubblicazione della presente" normativa.
Failure to provide information or inadequate information is subject to an administrative penalty ranging from €6,000 to €36,000 (Article 161 of the Code).
Installing cookies on users' terminals without their prior consent, however, entails a fine ranging from €10,000 to €120,000 (Article 162, paragraph 2-bis, of the Code).
Finally, failure to notify the Guarantor or failure to provide complete notification, pursuant to Article 37, paragraph 1, letter d), of the Code, is punishable by a fine ranging from €20,000 to €120,000 (Article 163 of the Code).
What to do to comply
Il Garante ha stabilito che quando si accede alla home page o ad una pagina di un sito web deve comparire un banner ben visibile, in cui sia indicato che il sito utilizza cookie di profilazione e consente l'invio di cookie di "terze parti", ossia di cookie installati da un sito diverso tramite il sito che si sta visitando, oltre che un link ad una informativa più ampia dove è possibile negare il consenso alla loro installazione o l'indicazione che proseguendo nella navigazione si concede il consenso all'uso dei cookie.
The site manager is permitted to use a technical cookie so as not to display the brief information again on the user's second visit.
